The Goods and Services Tax Appellate Tribunal (GSTAT) is the highly anticipated second appellate authority under the GST regime. Fully operational as of late 2025, the GSTAT serves as an essential forum for taxpayers seeking to resolve disputes arising from the orders passed by the first appellate authorities (Appellate Authority or Revisional Authority). Before the formation of GSTAT, taxpayers were forced to approach High Courts to seek relief for GST disputes, which was both costly and time-consuming.
Filing an appeal before the GSTAT, however, involves strict procedural prerequisites. To deter frivolous litigation and ensure revenue protection, Section 112(8) of the CGST Act mandates a pre-deposit before an appeal can be admitted by the GSTAT. The pre-deposit ensures an automatic stay on the recovery of the remaining disputed amount until the appeal is finally disposed of.

The standard limitation period for filing an appeal before the GSTAT is three months from the date the disputed order is formally communicated to the taxpayer. Missing this deadline generally results in the loss of the right to appeal.
Important Transitional Deadline: Due to the delay in establishing the GSTAT, thousands of appellate orders had piled up over the years. To manage this backlog, the government introduced a transitional extension. If your order was communicated before April 1, 2026, your deadline to file the appeal is automatically extended to June 30, 2026. If your standard three-month deadline falls after this date, the later date naturally applies.
